stealthray end user license agreement
This StealthRay End User License Agreement ("Agreement") is by and between name papa .com ("name papa .com"), an Arizona corporation and you, your heirs, assigns, agents and successors ("You") and is made effective as of the date of electronic execution.

By using StealthRay ("StealthRay" or "Software"), You agree to be bound by the terms and conditions set forth herein. You further agree that this Agreement may be amended from time to time and You agree to be bound by any new, different or additional terms Starfield may adopt from time to time. You may view the current version of this Agreement online.

1. software and service details
The Software
name papa .com grants You a non-exclusive license to use StealthRay for such purposes as are ordinary and customary. You are free to use StealthRay on any computer, but not on two or more computers at one time.

You may not alter or modify the Software. You are not authorized to combine StealthRay with any other software program, nor are You authorized to integrate any plug-in or enhancement which uses or relies upon StealthRay. You further agree not to reverse engineer, decompile or otherwise attempt to uncover the source code.

The Services

StealthRay is a privacy enhancement software product which is designed to assist You in protecting Your private information both online and on Your local computer. Installing and using StealthRay will give You the ability to protect Your identity in a number of ways. Among other things, You will be able to:

  1. Disable the ability of web sites You visit to collect certain information about You;
  2. Remove evidence of online activities and sessions from your hard drive;
  3. Remove cookies, cache memory and other temporary files placed on Your hard drive by web sites You visit;
  4. Encrypt the data stored in files on Your hard drive;
  5. Block pop-up windows from displaying, and
  6. Prevent data recovery from Your hard drive by shredding data stored on Your hard drive (system files, and other application-related files).

StealthRay v3.0
  1. All of the features of Stealthray v2.3, plus,
  2. Electronically store and manage online account information (account name, password, URL) and log into online accounts automatically,
  3. Create links to URLs and store them in an encrypted format,
  4. With one click, instantly hide and show all open windows displayed on your monitor from view, and
  5. Remove evidence of online activities and sessions from your hard drive in entirely or selectively; by removing cookies, cache files, log files, and other
  6. temporary files placed on Your hard drive by Web sites You visit and applications (including instant messaging applications) installed on your computer,
The Limitations
Despite its focus on privacy enhancement, StealthRay is not intended to assist You in engaging in unlawful or morally objectionable activities. Therefore, name papa .com explicitly reserves the right to terminate Your license if it comes to name papa .com's attention that You are using StealthRay to cover up Your participation in objectionable activities, which include, but are not limited to, the following: sending unsolicited email or spam; activities designed to defame, embarrass, harm, abuse, threaten, slander or harass third parties; activities prohibited by the laws of the United States and/or foreign territories in which You live or access the Internet; activities designed to encourage unlawful behavior by others, such as hate crimes, terrorism and child pornography; activities that are tortious, vulgar, obscene, invasive of the privacy of a third party, racially, ethnically, or otherwise objectionable; activities designed to impersonate the identity of a third party; or activities designed to harm minors in any way. Due to the encryption technology incorporated within StealthRay, name papa .com is not allowed to ship StealthRay outside of the United States, Canada, or a U.S. Territory. Also, the Software is not allowed to be used by anyone in a government agency or a government end-user. By using StealthRay, you agree and certify the following:

  1. You are downloading StealthRay to a computer that is within the United States, Canada or a U.S. Territory;
  2. You realize that StealthRay is subject to export controls under the Export Administration Regulations, 15 C.F.R. Parts 730-734, administered by the Bureau of Export Administration in the U.S. Department of Commerce and agree to be bound by those regulations;
  3. You will not transfer this software to a computer or a user outside of the United States, Canada or a U.S. Territory;
  4. You are not using this software for government purposes, nor are you a government end-user.

2. name papa .com's rights
name papa .com reserves all rights to this Software. StealthRay and any copies You are authorized to make are the intellectual property of name papa .com. The source code and its organization are the exclusive property of name papa .com and StealthRay is protected by copyright, including United States Copyright Law. Except as expressly stated in Section 1 above, this Agreement does not grant You any rights in StealthRay and all rights are reserved by name papa .com. name papa .com expressly reserves the right to: Modify pricing through email notification. Terminate Your license for unsolicited, commercial email or spam; illegal access to other computer networks (i.e., hacking); distribution of Internet viruses or similar destructive activities; and other activities whether lawful or unlawful that name papa .com determines to be harmful to subscribers, operations, its reputation, or otherwise. Terminate Your license if the Your use of StealthRay results in, or is the subject of, legal action or threatened legal action against name papa .com or any of its affiliates or partners, regardless of whether or not such legal action or threatened legal action is eventually determined to be with or without merit. The decision to terminate Your license shall be made solely by name papa .com, and in so doing, name papa .com shall not be required to consider the merits of legal action or whether threatened legal action will actually come to pass.


3. liability & indemnification
name papa .com provides StealthRay "as is" and without warranty or guarantee of any kind, either express or implied, including but not limited to, the implied warranties or conditions of merchantability or fitness for a particular purpose. In no event shall name papa .com be liable for any loss of profits, loss of business, loss of data, unsecured transactions, interruption of business, or for indirect, special, or consequential damages of any kind, even if name papa .com has been advised of the possibility of such damages arising from any defect or error in the Software. You shall indemnify, defend by counsel reasonably acceptable to name papa .com, protect and hold name papa .com harmless from and against any and all claims, liabilities, losses, costs, damages, expense, including consultants' and attorneys' fees and court costs, demands, causes of action, or judgments directly or indirectly arising out of or related to Your use of StealthRay.

4. severability
You agree that the terms and conditions of this Agreement are severable. If any part of this Agreement is determined to be unenforceable or invalid, that part of the Agreement will be interpreted in accordance with applicable as law as closely as possible, in line with the original intention of the parties to this Agreement. The remaining terms and conditions of the Agreement will remain in full force and effect

5. venue; waiver of trial by jury
This agreement shall be deemed entered into the state of Arizona. the laws and judicial decisions of Maricopa county, Arizona, shall be used to determine the validity, construction, interpretation and legal effect of this agreement. You agree that any action relating to or arising out of this agreement, shall be brought in the courts of Maricopa county, Arizona. You agree to waive the right to trial by jury in any proceeding that takes pace relating to or arising out of this agreement.

6. notices
You agree that all notices (except for notices concerning breach of this Agreement) from name papa .com to You may be posted on our web site. Notices concerning breach will be sent to You at either the postal address or email address You have on file with name papa .com. In either case, delivery shall be deemed to have been made five (5) days after the date sent. Notices from You to name papa .com shall be made by email, sent to the address we provide on our web site, or by first class mail to the address listed below.
